Terms of Service

1. Eligibility

You must be at least 18 years of age to use Fluxeta. By using the platform you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are using Fluxeta on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information.
• Promptly update your information if it changes.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.
• Not share your credentials with third parties.

We reserve the right to suspend or terminate accounts that we believe have been compromised or are in violation of these Terms.

3. Free Plan, Trials & Subscriptions

3.1 Free Forever Plan

Fluxeta offers a Free forever plan on both the Creator and Headless products. No credit card is required. The Free plan is not time-limited: your published content stays live within the Free-tier limits (subscribers, storage, bandwidth, emails, AI generations) published on the pricing page. If your usage exceeds Free-tier limits, the affected features (for example, additional email sends beyond the monthly quota) will pause until the next billing cycle or until you upgrade — your content itself is not deactivated or deleted.

3.2 30-Day Paid Trial

When you start a paid plan (for example, Creator Pro) we offer a 30-day trial with no charge. If you do not add a payment method or subscribe by the end of the trial, your account automatically drops back to the Free forever plan — it is not paused, deactivated, or deleted. Any content, subscribers or data that exceed Free-tier limits remain in your account and become accessible again the moment you upgrade.

3.3 Subscription Plans

Fluxeta offers monthly and annual subscription plans in Indian Rupees (INR). Current pricing, feature lists and platform-fee schedules are available at fluxeta.com/pricing — that page is the single source of truth for prices and features. We reserve the right to change pricing with 30 days' notice to existing subscribers.

4. Billing & Payments

All payments are processed by Razorpay, a PCI-DSS-compliant payment gateway. By subscribing, you authorise Razorpay to charge your payment method on a recurring basis according to your chosen billing cycle.

4.1 Refunds

Subscription fees are non-refundable except where required by applicable law. If you cancel mid-cycle, your subscription remains active until the end of the billing period.

4.2 Failed Payments

If a payment fails, we will retry twice over 7 days. If payment remains unsuccessful, your account will be suspended. Your content will be preserved for 30 days to allow you to reactivate.

4.3 Taxes

All prices are exclusive of GST. GST will be added at the applicable rate at checkout. You are responsible for any additional taxes applicable in your jurisdiction.

5. Your Content

You own your content. Posts, newsletters, pages, and media you create on Fluxeta remain your intellectual property. By using Fluxeta you grant us a non-exclusive, royalty-free, worldwide licence to host, store, transmit, and display your content solely to provide the service.

You are solely responsible for the content you publish. You represent and warrant that:

• You have all necessary rights to publish the content.
• The content does not infringe any third-party intellectual property rights.
• The content complies with all applicable laws.

When you delete content or close your account, we will remove your content within 90 days except where retention is required by law or for legitimate business purposes (e.g., payment records).

5.1 Third-Party Embedded Code

Fluxeta allows creators to embed third-party code on their sites, including advertising scripts (e.g., Google AdSense), tracking pixels, and custom HTML. You are solely responsible for any third-party code you embed. By embedding such code you represent and warrant that:

• You have the right and necessary permissions to embed the code.
• The embedded code complies with all applicable laws and regulations, including the Information Technology Act, 2000 and applicable data protection laws.
• The embedded code does not contain malware, spyware, or any code designed to harm, deceive, or surveil visitors to your site.
• You have disclosed to your readers, where required by law, the presence of advertising, tracking, or analytics code on your site.

Fluxeta does not review or validate third-party code embedded by creators and accepts no liability for any harm caused by such code to you, your readers, or any third party. We reserve the right to remove embedded code or suspend your account if we determine that any embedded code violates these Terms or applicable law.

6. Acceptable Use

You agree not to use Fluxeta to:

• Publish or distribute content that is unlawful, defamatory, obscene, or hateful.
• Infringe third-party intellectual property, privacy, or publicity rights.
• Distribute malware, spam, or phishing content.
• Embed third-party scripts, pixels, or code that harvests visitor data without consent, installs malware, or is otherwise deceptive or harmful.
• Attempt to gain unauthorised access to the platform or other users' accounts.
• Scrape, crawl, or extract data from the platform in a way that disrupts service.
• Use the platform for any purpose that violates the Information Technology Act, 2000 or other applicable Indian law.
• Impersonate any person or entity.

We reserve the right to remove content and suspend accounts that violate this Acceptable Use policy without prior notice.

7. AI Features

Fluxeta includes AI-powered writing tools (drafting, tone analysis, plagiarism detection, brand voice). These features are powered by third-party AI models. By using AI features:

• Your text inputs are sent to our AI sub-processors (Anthropic) for processing. See our Privacy Policy.
• AI-generated content is provided as a suggestion only. You are responsible for reviewing, editing, and publishing any AI-assisted content.
• We make no warranty that AI-generated content is accurate, non-infringing, or suitable for your purposes.
• Do not submit confidential, sensitive, or personal data (belonging to third parties) as input to AI features.

8. Creator Memberships & Payments

Creators using Fluxeta may charge their audience for access to premium content ("Memberships") and accept tips. As a creator:

• You are responsible for fulfilling membership benefits to your subscribers.
• Membership payments are processed by Razorpay. Fluxeta charges a platform fee deducted before payouts (see current fee schedule at fluxeta.com/pricing).
• You must comply with applicable GST / income tax obligations on your earnings.
• We reserve the right to withhold payouts where fraud or a chargeback dispute is pending.

As a member (subscriber to a creator):

• Membership fees are charged by the creator via Razorpay.
• Refund requests for memberships should be directed to the creator first. Where a creator is unresponsive, contact [email protected].

8A. Third-Party Sellers, Organizers and Payments

Fluxeta enables independent sellers, creators, businesses, event organizers, and other service providers to offer products and services to customers.

The relevant seller, creator, business, or event organizer identified on the applicable product, service, event, or checkout page is the party responsible for providing the purchased product or service to the customer.

Decipher Consultancy Services operates the platform as a technology and payment facilitation platform. Depending on the applicable transaction, Decipher Consultancy Services may retain a platform, service, or commission fee, while the applicable amount due to the respective seller, creator, business, or event organizer may be settled to their designated payment account.

Customers will be provided with relevant information identifying the applicable seller, creator, business, or event organizer during the purchasing or registration process and at the payment stage.

The seller, creator, business, or event organizer is responsible for the accuracy, quality, delivery, fulfilment, cancellation, refund, and provision of the applicable product or service, except where otherwise expressly stated on the platform.

By completing a transaction, the customer acknowledges that the identified seller, creator, business, or event organizer is the provider of the relevant product or service and that the platform is operated by Decipher Consultancy Services.

9. Intellectual Property

Fluxeta, its software, design, trademarks, and platform features are owned by Decipher Consultancy Services and are protected by Indian intellectual property law. Nothing in these Terms grants you any licence to use our trademarks, trade names, or branding.

If you believe content on the platform infringes your copyright, please send a notice to [email protected] with details of the infringement and your contact information.

10. Disclaimers

Fluxeta is provided "as is" and "as available" without any warranty of any kind. We do not warrant that:

• The platform will be uninterrupted, error-free, or free of viruses.
• The results obtained from the platform will be accurate or reliable.
• Any defects will be corrected.

To the maximum extent permitted by Indian law, we disclaim all express and implied warranties, including merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Decipher Consultancy Services, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Fluxeta, including loss of data, loss of revenue, or loss of goodwill.

Our total aggregate liability to you for any claim arising under or related to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

12.1 By You

You may close your account at any time from the Settings page. Closure takes effect immediately. Your content will be retained for 90 days and then deleted.

12.2 By Us

We may suspend or terminate your account immediately, without notice, if we determine that:

• You have violated these Terms or our Acceptable Use policy.
• Your account is involved in fraudulent or illegal activity.
• Continued access poses a risk to other users or to the platform.

12.3 Effect of Termination

Upon termination, your right to use Fluxeta ceases immediately. Sections 5 (Your Content — ownership provisions), 9 (IP), 10 (Disclaimers), 11 (Liability), and 13 (Governing Law) survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Before initiating legal proceedings, we encourage you to contact us at [email protected] to resolve disputes amicably. Most issues can be resolved within 10 business days.

14. Contact

We may update these Terms from time to time. Material changes will be communicated by email and by notice on the platform at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
